Will Christopher Schurr drive again?

On Thursday, the judge declared a Mistrial in the case against the former Grand Rapids Police officer Christopher Schurr when the jury could not make a unanimous decision.

The decision about whether Schurr retelling again or not lies in the hands of the public prosecutor of Kent County, Chris Becker.

The defense lawyer Don Sappanos said it would not be an easy decision for Becker.

“I suspect that the prosecutor will seriously think about refraining from it, but in my opinion this problem is in the middle in the middle,” said Sappanos. “Half of the people think they know that the police officer should be able to use deadly violence. Half of the people think that an official should not use fatal violence under any circumstances. If he progresses with a second legal proceedings, I could certainly see another hung jury.”

The civil servant, accused of murdering the second degree, could turn to life in prison with the possibility of probation, but after the declared Mistrial he is a free man for the time being.

Becker currently has a lot of complexity after speaking to the Lyoya family and the jurors who could not get a unanimous decision if Schurr was actually guilty.

“It is still my decision, which is ultimately based on all facts and circumstances,” said Becker during a press conference on Thursday. “I spoke to the family and said: ‘Give me some time, we all digest it at that time.’ And I think your feelings should play a role. “

Sappanos said that if Becker decides against another process, there are still a few different options.

“What could happen is that the prosecutor die on the vine and does not charge,” said Sappanos. “He could charge himself or you could try to know it, to negotiate a deal, try both sides to meet in the middle or meet somewhere to satisfy the accused and the prosecutor,” said Sappanos.

Sappanos told News Channel 3 that it would be a professional decision for Becker.

Becker confirmed that he would make a decision by the end of the month.
