The judge refuses to apply to the public prosecutor’s office to personality tests

A judge in Idaho denied the public prosecutor’s request to carry out personality tests on four -murder -suspect Bryan Kohberger.

Kohberger is charged with the first degree murder of the students of the University of Idaho Kaylee Goncalves, 21, Xana Kernodle, 20, Madison Mogen, 21, and Ethan Chapin, 20.

In an order on Wednesday, judge Steven Hippler denied the state’s request to carry out a personality test for Kohberger, citing time restrictions.

Hippler wrote that “all new potential diagnoses or evidence that were uncovered by personality tests can cause the need for further tests”, which would require more time to be issued.

He also wrote that the use of a personality test has the potential to uncover “new mental health diagnoses” that have not been disclosed, which could exceed a legal line, since Kohberger has only given up data protection rights for conditions that he has unveiled.

Kohberger’s defense team should not provide any statements that Kohberger has a “personality disorder”.

Hippler also extended a deadline for refuting the refutation, which gives the prosecutors more time for their experts in order to complete a behavioral health test. The prosecutors try to refute defense experts who claimed that Kohberger has autism, obsessive-compulsive disorders and attention deficit hyperactivity disorder.

The judge gave the prosecutors until May 27 to conclude the report, but noticed that Kohberger’s defense team could not be present during the mental health examination.

In a separate order, Hippler decided that Kohberger’s immediate family members can remain in the courtroom for the duration of the trial, even though the prosecutors plan to call some of them as witnesses.

In April, Hippler returned two separate applications from Kohberger’s defense team to be used in this case.

During a hearing on April 9, the defense team argued that the death penalty should be hit because the discovery made by the public prosecutor was both voluminously and disorganized.

In his answer, Hippler wrote that Kohberger’s complaints about the amount of discovery “Ring Hollow” were created.

“(Kohberger) has received discovery in the same way for over two years,” Hippler wrote. “(Kohberger) has not applied for any additional resources to commission additional employees to check the discovery or to receive software for controlling legal disputes in order to organize and sort evidence.
